(1) A person commits the offense of tampering if, believing that an official proceeding or investigation is pending or about to be instituted, the person knowingly or purposely attempts to or does (a) induce or otherwise cause a witness or informant to testify or inform falsely, (b) withhold any testimony, information, document or other material evidence, (c) cause a witness to elude legal process summoning the witness to testify or supply evidence, or (d) alter, destroy, conceal, or remove any record, document, or other physical object in order to impair its availability or reliability in such proceeding or investigation. (2) Tampering is a Class D offense over which the Tribes have exclusive jurisdiction.
