Notwithstanding any inconsistent provision of law with respect to survival of civil actions, the three-year period for filing a civil action as provided by § 29-13-403(b) does not begin to run until:
(1) All moneys owing to the defendant under the terms of the contract have been paid to the attorney general and reporter and
(2) An escrow account has been established for the benefit of the defendants victims.
