Yes, the department may consider the following issues in the decision. The list is not inclusive.
(1) Justice:
(a) Gravity of the criminal offense
(b) History of criminal convictions
(c) Type of crime
(d) Circumstances surrounding the criminal act
(e) Sentence imposed by the court.
(2) Well-being of the victim:
(a) Extent of injury to victim
(b) Safety of victim
(c) Dependency of the victim on the offender
(d) Recovery of victim.
(3) Rehabilitation of the individual:
(a) Attempts at rehabilitation
(b) Employment status
(c) Ability to pay.
