The defendant was convicted of welfare fraud and ordered to pay $684 in restitution as a condition of probation. On appeal, the defendant claimed that the trial court erred in ordering restitution in the amount of $684. The court found that the matter was discussed in State v. Benoit, 313 A.2d 387 (Vt. 1973), and reversed and remanded with directions to the trial court to impose sentence in conformance with views expressed in the case.
