Cases | State of New Jersey in the Interest of R.V., a Juvenile, 654 A.2d 999 (N.J. 1995) | 2018

A juvenile hit a victim with a baseball bat, causing the victim to be hospitalized for his injuries. Without a hearing, the trial court ordered restitution for the unchallenged amount of the victim’s medical bills. The juvenile appealed the summary imposition of restitution without a hearing. The appellate court remanded the case for a hearing to set the restitution’s conditions and terms, such as how it could be paid, how payment would affect the appellant, or the appellant’s ability to pay and his prospects for future employment.
