The defendant was convicted of indecent assault and corruption of minors in connection with the sexual assaults of two teenage boys. On four occasions, the defendant requested that the Pennsylvania Board of Probation and Parole (Board) provide him with copies of victim impact statements relating to his imprisonment, and upon which the Board relied in making its decision not to grant him parole. The Board denied the requests, asserting that the information was confidential. On appeal, the court concluded that the Board, at its discretion, could deem written statements of crime victims or family members confidential if safety required, and that the Board had not abused its discretion in this case.
