The defendant was convicted of numerous counts of theft by deception, attempted theft by deception, and tampering with public records. At the sentencing hearing, the defendant agreed, through his attorney, to a restitution figure of $62,745. The trial court ordered this as the amount of restitution. Thereafter, the defendant appealed, arguing that the trial court improperly imposed restitution. The Superior Court of Pennsylvania affirmed the trial court’s order with respect to this issue. The court noted that the defendant did not challenge his sentence of restitution at the sentencing hearing. In addition, the defendant’s counsel agreed to the amount of restitution. This amount was the same amount suggested by the pre-sentence report. Since restitution was permissible in this case, the court upheld the sentence.
