The defendant was convicted of criminal mischief and agricultural vandalism after he damaged two farming combines. For purposes of grading the offenses, the jury found that the loss sustained by the victim was greater than $1,000, but less than $5,000. At the time of sentencing, however, the court was presented with estimates and repair bills totaling $20,745.82. Thus, the trial court issued an order of restitution in the amount of $20,745.82. The defendant appealed, arguing that the sentencing court erred in ordering him to pay restitution in an amount that exceeded the amount of damages determined by the jury for the purpose of grading the offenses. The Superior Court of Pennsylvania concluded that the restitution order was supported by the record before the sentencing court, and affirmed the judgment of sentence.
