Cases | George v. Beard, 824 A.2d 393 (Pa. Commw. Ct. 2003) | 2018

The petitioner, an inmate at a state correctional institution, filed a petition for review, arguing that the department of corrections improperly deducted funds from his inmate account to satisfy his sentenced financial obligations. First, the Commonwealth Court of Pennsylvania concluded that the petitioner was not entitled to a hearing to determine his financial ability to pay his sentenced financial obligations. Furthermore, the department of corrections had a statutorily mandated duty to deduct funds from the petitioner’s account. Finally, the petitioner was not entitled to reimbursement from the department of corrections for funds deducted from his account.
