The petitioner, an inmate at a state correctional institution, was involved in the assault of another inmate. At a hearing to determine the amount of the costs incurred by the Commonwealth as a result of the petitioner’s misconduct, the petitioner was ordered to reimburse the Department of Corrections (DOC) in the amount of $1,879.55 to cover the costs of the medical care provided to the victim. The petitioner sought review of the order. The Commonwealth Court of Pennsylvania concluded that the DOC was an administrative agency, and as such, had the statutory and regulatory authority to assess the petitioner’s account after he was found guilty of misconduct at the correctional institution.
