The defendant pled guilty to accomplice to criminal mischief and agreed to pay restitution as part of the plea agreement. The defendant challenged the restitution order on several grounds. In affirming the judgment and order, the court cited case precedent stating that N.D. Cent. Code § 12.1-32-08 does not apply when restitution is agreed to in a plea bargain.
