Two police officers sustained damage to their vehicles while pursuing the defendant in a high-speed chase. A third officer experienced loss of engine power on the way to the scene, though the defendant was already under arrest when he arrived. The defendant pled guilty to fleeing or attempting to elude a police officer and was ordered to pay restitution for damage to the two officers’ vehicles, in addition to damage to the third officer for engine damage. The defendant challenged the restitution order to the third officer on several grounds. The supreme court affirmed the conviction but reversed and set aside the order directing restitution to the third officer. The recitation of facts regarding the role played by the officer was not from the record but from the parties’ briefs, and did not indicate that damage to the vehicle was actually incurred as a direct result of the defendant’s criminal action.
