Cases | State v. Bergeron, 326 N.W.2d 684 (N.D. 1982 | 2018

The defendant was convicted of driving while license suspended and unauthorized use of a vehicle. On appeal, the defendant requested a remand so that a restitution hearing could be held. The supreme court affirmed the conviction of guilt but reversed the order of restitution and remanded for a separate restitution hearing. A restitution hearing was required because disputed issues included the amount of restitution and whether the alleged damage to complainant’s vehicle occurred during the defendant’s unauthorized use.
