Cases | State v. Moore, 754 P.2d 293 (Ariz. 1988) | 2018
The defendant pled guilty to kidnapping and first-degree murder. The defendant was sentenced to life imprisonment without the possibility of parole and was ordered to pay restitution. On appeal, the defendant contended that the trial court exceeded its authority in ordering restitution payments to begin while he was incarcerated. The appellate court affirmed the conviction and sentence. The trial court was authorized to order restitution pursuant to Ariz. Rev. Stat. §§ 13-603(C) and 31-254(D). Further, the trial court complied with its mandate under Ariz. Rev. Stat. § 13-804(D) to consider the defendant’s economic circumstances in that it gave him nine years to accumulate sufficient money in his prison account to allow an annual payment.
