Cases | Hollingsworth v. State, 835 So. 2d 373 (Fla. Dist. Ct. App. 2003) | 2018
The defendant was ordered to pay restitution to the minor victim’s mother for the mother’s lost wages. On appeal, the defendant argued that the mother was not a victim under Florida’s restitution law. The court of appeals held that under the amended statute, “it is clear that a victim’s mother could be entitled to restitution if she suffered property damage or loss, monetary expense, or physical injury or death,” as she did here “as a result of being unable to go to work because of the emotional turmoil caused by [the defendant’s] offense.” The order of restitution was affirmed.
