Cases | Kirk v. State, 869 So. 2d 670 (Fla. Dist. Ct. App. 2004) | 2018

The defendant pled guilty to aggravated battery and was ordered to pay $35 restitution to the Division of Victim Services every month. On appeal, he argued that the sealed document offered to prove the amounts paid by the Division of Victim Services on behalf of the victim was not sufficient to support the award. The State argued that section 960.14 specifically authorized such an award and that the sealed document was self-authenticating and sufficient to prove the amount of restitution by a preponderance of the evidence. The court of appeals held that the document was self-authenticating and supported the trial court’s finding of amounts of restitution. The order was affirmed.
