The defendant was ordered to pay extradition costs incurred by the county in transporting him to South Carolina from another state to be tried for a parole violation. On appeal, the defendant claimed that the county was not a “victim” under S.D. Codified Laws § 23A-28-2. The court held that though the county did not fit the statutory definition of “victim,” extradition costs were recoverable as prosecution costs under S.D. Codified Laws § 23A-27-26.
