Cases | People v. Good, 282 N.W. 920 (Mich. 1938) | 2018
The defendant was convicted of negligent homicide and ordered to pay restitution as a condition of probation. The supreme court found that the order was invalid because it permitted the probation department to determine how restitution would be made by the defendant. Section 17373, as amended, permitted the court to impose conditions of probation including restitution and contained no authorization for a delegation of the duty, in whole or in part, to the probation department. The probation department could act at most in an advisory capacity.
