The defendant was convicted of receiving and concealing stolen property valued over $100 and concealing or misrepresenting the identity of a motor vehicle with intent to mislead. He was ordered to pay $42,160 for the receiving and concealing conviction. On appeal, the defendant claimed that restitution was excessive in light of his ability to pay. The appellate court found that the defendant had not brought the issue properly before it because he failed to raise the issue in the lower court. The defendant did not request an evidentiary hearing to determine his ability to pay restitution.
