The defendant was convicted of second-degree murder and ordered to pay restitution for loss of income to the victim’s father. The defendant appealed. The appellate court remanded to trial court for a determination of the amount of restitution that constituted the father’s loss of income so that it could be subtracted from the total restitution ordered by the court. The Legislature sought to distinguish expressly between the “victim” and the “victim’s family.” For purposes of the Crime Victim’s Rights Act, the victim’s father was not the “victim” and therefore was therefore ineligible to recover wage loss.
