Cases | State v. Boudreaux, 741 So. 2d 860 (La. Ct. App. 1999) | 2018
The defendant forged checks and deposited them into her personal account. The defendant was convicted of forgery and ordered to pay $33,4986.90 in restitution as a condition of probation. The defendant objected to the amount, arguing that it covered checks for which she was not charged. The trial court denied the objection and the defendant appealed. The appellate court held that the trial court was correct in ordering restitution in the amount of $33,4986.90. Though the defendant was not charged with the false making of the checks for which she actually received cash, she was charged with altering canceled checks in order to facilitate her forgery scheme. Because the defendant’s offense facilitated the forgery scheme by which she caused $33,4986.90 worth of loss to the victim, the victim’s damage was caused by the offense committed by the defendant.
