The defendant was convicted of second degree battery and ordered to pay restitution upon determination of parole. The defendant appealed. The appellate court vacated the order imposing restitution to the victim as a condition of parole. The trial court acted without authority, as the legislature vested the board of parole with authority to impose conditions of parole as it related to victim restitution.
