Cases | State v. Riley, 605 S.E.2d 212 (N.C. Ct. App. 2004) | 2018
The defendant pled guilty to six counts of embezzlement and was ordered to pay $78,081 as a condition of probation. On appeal, the defendant claimed that the trial court erred in failing to make findings of fact regarding ability to pay. The appellate court affirmed the restitution order. The defendant earned enough each month to make the required payments and failed to present evidence showing that she would not be able to make her required payments. Further, there was support in the evidence for the amount ordered.
