The defendant was convicted of uttering a forged instrument. The trial judge imposed restitution as a condition of parole. On appeal, the defendant claimed that the trial judge had no authority to impose restitution as a condition of parole. The State conceded. The court agreed and reversed the part of the sentence conditioning parole upon making restitution.
