The defendant was convicted of two counts of capital murder and one count of attempted capital murder. He appealed, arguing, among other things, that his trial counsel was ineffective in failing to object to the State’s victim-impact testimony. The Supreme Court of Arkansas affirmed, noting that the defendant cited no authority that indicated why the testimony constituted improper victim-impact evidence or that his attorneys would have been successful had they raised this argument on appeal. The Court concluded that the victim-impact evidence was not used improperly and was submitted in accordance with state law.
