Cases | Milton v. State, 137 S.W.3d 402 (Ark. Ct. App. 2003) | 2018
The defendant pled guilty to the charge of failing to stop after an accident involving death or personal injury. Among other things, he was sentenced to pay $25,000 in restitution to the victim’s family. The defendant appealed the portion of the sentence ordering restitution, arguing that restitution was ordered with no evidence in the record of actual economic loss by any of the victims, as required by the relevant statute. The Court of Appeals of Arkansas, Division One, affirmed, noting that since the defendant failed to raise this argument with the trial court, it would not address the issue on appeal.
