Cases | Simmons v. State, 205 S.W.3d 194 (Ark. Ct. App. 2005) | 2018
According to the order in this case, the defendant “entered a negotiated plea of guilty or nolo contendere” to the theft of items valued at a restitution hearing at $2,037.59. However, he was ordered to pay restitution in the amount of $10,140.76, which included restitution for the theft of items for which he was not charged. The defendant appealed. The Court of Appeals of Arkansas, Division Three, reversed and remanded, holding that the trial court erred in ordering the defendant to pay restitution for items he was never charged with stealing and for which he never pled guilty or no contest to stealing.
