The defendant was convicted of one count of sexual assault after assaulting his fifteen-year-old stepsister. He was sentenced to prison time and was ordered to pay $1,000 restitution to the Clark County Sexual Abuse Compensation Fund, restitution to the victim for future counseling costs, and fees. On appeal, the supreme court raised, sua sponte, the fact that the trial court had not set a dollar amount for future counseling costs. It held that this failure was a violation of the restitution statute. The judgment of restitution to the victim was reversed and the case remanded for resentencing on this issue; the judgment was otherwise affirmed.
