Cases | 835 N.E.2d 42 (Ohio Ct. App. 2005) | 2018
The defendant was convicted of aggravated burglary following a home invasion robbery. The defendant was sentenced to ten years in prison and ordered to pay $15,000 in restitution for injuries to the victims and for items stolen from the home, based on testimony from the victims. The defendant appealed, arguing the order of restitution was improper because it was not supported by evidence. The appellate court found the victims had testified to injuries they sustained in the attack and what was stolen from the home but had provided no evidence of economic loss. Because the record contained no evidence to support the amount, the order was improper. The order of restitution was remanded for determination.
