The defendant pled no contest to misdemeanor assault and was sentenced to 180 days in jail and two years of probation, and was ordered to pay $11,277 in restitution for medical expenses and $4,124 in lost wages as a condition of his probation. The defendant appealed, arguing the order of restitution was improper because reimbursement of medical expenses and lost wages was not authorized by the statute for misdemeanor convictions. The appellate court found though the misdemeanor penalty statute authorized only reimbursement for property damage, the probation conditions statute did authorize restitution for medical expenses and lost wages as a condition of probation. The order of restitution was affirmed.
