(a) Authorization for Petition
In addition to those authorized to file under section 140.2.01, a caseworker from the Division of Human Services may file a petition for a protective order under this chapter where the division has received a report of abuse or neglect of an elder or dependant adult, has investigated the report, and reasonably believes that a protective order is necessary to ensure the health, safety, and well being of the elder or dependant adult.
