4.04. Second Offense

A person convicted of a second offense of domestic violence within five (5) years shall be imprisoned for a term of not less than thirty (30) days or more than one (1) year and fined an amount not less than five hundred dollars ($500.00) or more than Five Thousand Dollars ($5,000.00). Mandatory counseling shall be part of sentencing as provided in Article V, as well as restitution when appropriate.
