The Juvenile Court may transfer jurisdiction of the minor to adult Tribal Court if the Juvenile Court finds by clear and convincing evidence that the following circumstances exist:

    • There is probable cause to believe that the minor has committed the offense(s) alleged and

    • There arc no reasonable prospects for rehabilitating the minor through resources available to the Juvenile Court and

    • The offense(s) allegedly committed by the minor evidences (c) a pattern of conduct which constitutes a substantial danger to the public.
