(1) The identity of the person making the report, and the report itself, are to be confidential.

(2) All files, reports, records, communications, and working papers used or developed for investigation or provision of protective services are to be confidential.

(3) The Tribal Court may order disclosure of confidential information only if the Court determines that disclosure is essential to the administration of justice and will not endanger the life or safety of the Elder or Vulnerable Adult, or individual who made the report. The Court, in a hearing, may place restrictions on such disclosure as the Court deems appropriate and essential for the Court proceedings.
