A person is considered incapable of consenting to a sexual act if he is:
A. Under 18 years of age
B. Mentally defective
C. Mentally incapacitated
D. Physically helpless or
E. Incapacitated for any reason, including by the voluntary or involuntary use of intoxicants, medication or drugs.
