The crime of child abuse occurs when a parent, guardian or other person responsible for the welfare of a child willfully or maliciously injures, bruises, strikes, beats, kicks, bites, physically tortures, maims or uses any other form of unreasonable force upon a child or causes or procures any of said acts to be committed upon a child by another person. Provided, that this section shall not prohibit any parent, guardian or other person responsible for the child's health or welfare from using reasonable, ordinary force as a means of discipline, including but not limited to spanking provided said disciplinary action does not cause unreasonable harm or injury to the child. Any person convicted of violating the foregoing provision shall be guilty of a felony.
