The crime of abandonment of an incapacitated spouse occurs when a person knowingly abandons an incapacitated spouse or persistently fails to provide support which he or she can provide and which he or she is legally obliged to 216 Title 14, § 2&ndash906 CRIMES & PUNISHMENT provide to that spouse. Any person convicted of violating the foregoing provision shall be guilty of a misdemeanor.
