The crime of uttering a forged instrument occurs when a person offers as genuine a false writing which the Actor knows is false and which is offered with the intent to defraud. Any person convicted of violating the foregoing provision shall be guilty of a felony when the amount of the check written is equal to or greater than five hundred dollars ($500) and shall be guilty of a misdemeanor when the amount of the check written is less than five hundred dollars ($500).
