The crime of exposing others to a sexually transmitted disease occurs when a person who is infected with a sexually transmitted disease engages in sexual intercourse or sodomy with another person with the intent to infect that person with the sexually transmitted disease or when a person who is infected with the Human Immunodeficiency Virus engages in sexual intercourse, sodomy, donating blood, transferring blood through the skin or membrane of another person or biting another person. To be guilty, the person must act without using proper barrier protection and without informing the other person of the presence of the Human Immunodeficiency Virus and the act or acts must be done with the intent to infect any other person with the Human Immunodeficiency Virus.
