In determining the character and duration of the sentence which shall be imposed, the court shall take into consideration the previous conduct of the defendant, the circumstances under which the offense was committed, the effect of the offense upon the community, statements or opinions of the victims, statements or opinions of experts, and whether the offense was malicious or willful, and whether the offender has attempted to make amends and shall give due consideration to the extent of the defendant&rsquos resources and the needs of his dependents. It should be noted that the penalties listed in Chapter 9 of the Code are in most cases maximum penalties. The Judge will be expected to consider all of the circumstances of each case to determine whether a lesser penalty or the maximum is to be imposed.
