A person or entity who causes abuse, neglect, exploitation, or abandonment to an Elder or Vulnerable Adult has committed a civil infraction. In addition, a person or entity who fails to abide by the requirements and prohibitions under this Chapter has committed a civil infraction. Kalispel Tribal Police and the Tribal Prosecutor have the authority to issue Notices of Infractions, which shall be adjudicated pursuant to KLOC Chapter 21 Administrative Code. A person or entity who commits a civil infraction under this Chapter is subject to a civil penalty of up to $5000. Nothing in this Chapter precludes criminal prosecution in addition to a civil penalty if a crime has been committed.
