(a) Whoever knowingly persuades, induces, entices, or coerces any individual to engage in prostitution, or in any sexual activity for which any person can be charged with a criminal offense, or attempts to do so, shall be punished by a fine of not more than $5000.00, imprisonment for not more than One (1) year, or banishment for a period of not more than Five (5) years, or a combination thereof or

 

(b) Whoever, knowingly persuades, induces, entices, or coerces any individual who has not attained the age of 18 years, to engage in prostitution or any sexual activity for which any person can be charged with a criminal offense, or attempts to do so, shall be punished by a fine of not more than $5000.00, imprisonment for not more than One (1) year or banishment for a period of not more than Ten (10) years, or a combination thereof.
