Any person who shall willfully take possession of any goods, wares, or merchandise offered for sale without paying the purchase price thereof, shall be deemed guilty of an offense, and upon conviction thereof, shall be sentenced to labor or imprisonment for a period of not to exceed ninety (90) days or a fine not to exceed One Hundred Eighty Dollars ($180.00), or both.
