Any person who shall, having lawful custody of property not his own, appropriate, or cause to be appropriated, the same to his own use, or the use of another, with intent to deprive the owner thereof, shall be deemed guilty of an offense and upon conviction thereof, shall be sentenced to labor or imprisonment not to exceed one hundred eighty (180) days or a fine not to exceed Three Hundred Sixty Dollars ($360.00), or both such imprisonment and fine with costs, in extreme or habitual cases.
