(a)

Purpose. Each member of the Mohegan Tribe is a valuable asset to the community as a whole. The Mission Statement adopted by a consensus of the Mohegan Council of Elders on June 19, 1997 states in part "We respect our elders and all that comes from Mundu&hellip. We walk as a single spirit on the Trail of Life. We are guided by thirteen generations past and responsible to thirteen generations to come." The purpose of this Article is to assure that we protect our elder and disabled members from abuse and neglect to the extent possible.

Intent. The Mohegan Tribal Council has determined that it is in the best interest of the Mohegan Tribe to provide protective services to elder and disabled tribal members. It is the intention of the Mohegan Tribal Council to prevent abuse, neglect, exploitation or abandonment of its elder and disabled members. Accordingly it is the intention of the Mohegan Tribal Council to provide such services necessary to maintain physical and mental health while preserving the persons right to self-determination. This shall be accomplished by the establishment of the Elder and Disabled Protection Team and the coordination of the prevention, intervention, treatment of neglect and abuse and evaluation of such services. The team shall coordinate and collaborate with its own internal resources as well as agencies external to the Tribal government for those services necessary for the care of the identified tribal member. The major goal of the team is to help the elder and disabled individual remain in the living situation he or she prefers, safeguard legal rights, prevent bodily injury or harm, determine service needs and mobilize resources to provide necessary services. The team shall not be the responsible criminal investigative and prosecutorial agency.
