(a)

The Executive Director may, as the department head of Health and Human Services, establish an Elder and Disabled Protection team for the purpose of reviewing particular cases or types of cases to coordinate the prevention, intervention, treatment of elder or disabled abuse and neglect cases and evaluation of such services. The purpose of the team is to coordinate and collaborate with its own internal resources and agencies external to the Tribal government, those services necessary for the care of identified individual and to make such recommendations as the team may deem necessary. The team shall not be the responsible criminal investigative and prosecutorial agency.

(b)

The team may include the following individuals:

(1)

The Tribal Attorney as assigned

(2)

The Executive Director of Health and Human Services

(3)

The Director of Family Services

(4)

The Case Manager

(5)

The Recreation and Community Services Director

(6)

A designated Public Safety Department representative

(7)

The Executive Director, Housing Authority and

(8)

An ad hoc representative from the Council of Elders if needed to discuss relevant cultural traditions

and any other appropriate individual with specific expertise that members of the team deem necessary. The team may invite experts to participate in the review of any case and may invite any individual with particular information germane to the case to participate in such review, provided the expert or individual shall have the same protection and obligations as identified elsewhere in this Article.

(c)

Specific case discussions will have the minimal participation necessary to achieve the necessary work in the most confidential manner.

(d)

The team shall at its discretion keep minutes that do not identify cases by name but may choose to not record the discussions due to the focus on care planning and problem solving.

(e)

The team shall initiate a review of each case within ninety (90) days and each ninety (90) days thereafter, to determine whether continuation of, or modification in, the services are warranted. A decision to continue or modify the provision of services should be made in concert with appropriate personnel from other involved agencies, groups and departments.
