Defendant was convicted of five theft counts arising from failure to report assets on public assistance applications. The trial court ordered defendant to pay restitution for all funds received, including those for which he was not charged because they were received outside of the statute of limitations. Defendant appealed. The appellate court held that the trial court erred in ordering restitution concerning funds received by defendant outside of the period covered by the statute of limitations. The statute of limitations applies to restitution orders.
