Defendant caused a car accident resulting in the victim’s death. Defendant was convicted of vehicular homicide and ordered to pay restitution to the victim’s husband as a condition of probation. Defendant appealed. The court held that the trial court lacked statutory authority to order restitution to the victim’s husband as a condition of probation. Payment of restitution is authorized only as to the victim of defendant’s conduct. Defendant was charged and convicted only of conduct causing the victim's death.
